1. Service

Presupuestero provides a quote-creation tool for self-employed contractors (autónomos) in Spain and the EU. The Service is offered on a subscription basis with a 14-day trial.

2. Eligibility

You must be at least 18 and legally able to enter into a contract. The Service is intended for use by self-employed people and small businesses, not consumers.

3. Your account

• You're responsible for your account credentials and activity.
• You must provide accurate billing information (NIF, fiscal address) for invoicing.
• One workspace per account in v1; multi-user is on the roadmap.

4. Acceptable use

You agree not to:

• upload illegal, infringing, or harmful content;
• use the AI features to produce content that defrauds clients (false specs, inflated quantities) — we reserve the right to terminate accounts that do;
• attempt to access other workspaces' data or otherwise breach our security model.

5. Subscription, billing, cancellation

• Plans are billed monthly in advance via Stripe. Prices are listed on the pricing page and may change with 30 days' notice.
• You can cancel any time from /settings; your workspace remains accessible until the end of the paid period and then transitions to read-only.
• Failed payments enter a 7-day grace period; after that, the workspace downgrades to read-only until billing is resolved.
• Refunds are at our discretion within the first 14 days of a paid month. [LEGAL-NEEDED — confirm against EU consumer law where applicable.]

6. Intellectual property

You own the quotes, photos, voice memos, and other content you upload (“Your Content”). You grant us a limited license to host, process, and serve Your Content as necessary to operate the Service. We don't train AI models on Your Content. Presupuestero's interface, code, and brand are ours.

7. AI processing

Voice memos, photos, and visual-similarity search are processed by Google Vertex AI (Gemini 3 Flash and Gemini 3.1 Pro for extraction; Vertex multimodal embedding model for visual search). Extraction calls run on Google's globalVertex AI endpoint — inference requests on that route may be processed outside the EU and Google does not guarantee EU-only processing for it. Categorisation, PII detection, rate-card extraction, and visual-similarity search run inside the EU oneurope-west1. (If a preview Gemini embedding model is enabled in the future, visual-search inference may run onus-central1instead — that route is currently disabled.) By using AI features you agree to this routing. Database storage, file storage, and application hosting remain inside the EU; only the AI inference call (on the global endpoint) leaves the guaranteed-EU path. The AI's output is suggested, not authoritative — always review extracted items before sending a quote. We're not liable for AI errors you ship to a client without reviewing. [LEGAL-NEEDED — counsel to confirm whether opt-in consent (separate from these Terms) is required for extra-EU AI processing of personal data contained in the input.]

8. Disclaimer and liability

The Service is provided as-is. Our aggregate liability for any claim related to the Service is capped at the fees you paid us in the 12 months preceding the claim. Mandatory consumer rights under Spanish and EU law are not affected.

9. Termination

We may suspend or terminate your account for breach of these Terms, for non-payment after the 7-day grace, or for legal reasons. On termination, you may export your data within 30 days; after that we delete it according to the retention schedule in the Privacy Policy.

10. Governing law

These Terms are governed by Spanish law. Disputes go to the courts of [LEGAL-NEEDED — confirm jurisdiction with counsel].
